About
Tobin B. Horton is a
Partner who practices civil litigation and has had several successful
appearances in both Superior Court and Divisional Court in Ontario. Although he
has secured a number of favorable decisions in court, Mr. Horton recognizes
that cases are won both inside and outside of the courtroom so he employs
situationally appropriate techniques to maximize his clients’ strengths, while
minimizing their risks.
Tobin graduated from law school at the University of Ottawa in 2009 and was called to the Ontario bar in 2010. Following his call to the bar, he has worked extensively in an insurance defense litigation capacity. His personal injury practice focuses on defending claims involving occupier’s liability, product liability, commercial host and liquor law liability, social host liability, sports and recreation liability, municipal liability, motor vehicle accidents, and professional negligence. He also manages very active property damage and construction practice, which deals with issues of negligent design and construction, subrogation, cargo and shipping losses, water loss, and fire loss claims. Mr. Horton has also handled wrongful dismissal claims, employment disputes, and estate litigation. He also works for Zuber and Company LLP.
Additionally, in light of
being involved in environmental remediation claims outside of Ontario, Mr.
Horton is a member of the Law Society of Alberta and Law Society of Nunavut.
Mr. Horton is also recognized as a Certified Specialist in Civil Litigation by
the Law Society of Ontario.
Mr. Horton does work for
domestic, American, and international insurers and self-insured business
entities, and ensures that his approach best suits the needs of the claim and
the demands of both the client and the insured. He has the necessary skill and
experience to handle the largest and most complicated claims down to the
simplest and most modest disputes. He has the flexibility to adapt to various
approaches and requirements for any type of litigation work.
In 2021, Mr. Horton had the
unique opportunity to be the lead counsel on a three-week, virtual trial. Being
one of the few counsels in the Province who has conducted a virtual trial, he
is extensively familiar with the marshaling of evidence and cross-examining
witnesses by way of a virtual medium.
